Article 1 – Definitions
For the purposes of these Terms of Service, the following definitions apply:
Withdrawal Period: The period during which a customer is entitled to cancel a purchase in accordance with Article 6.
Consumer: An individual purchasing goods for personal use, not in connection with a trade, business, or profession, who enters into a distance contract with Dorothy Margaret New York.
Recurring Agreement: A distance contract involving an ongoing series of products or services supplied over time.
Right of Withdrawal: The consumer's entitlement to cancel a distance contract within the applicable withdrawal period.
Company: Dorothy Margaret New York, hereinafter referred to as "the Company," "we," or "us."
Distance Contract: Any agreement concluded remotely between the Company and the consumer through our website or other electronic means.
CESOP: The European Union's Central Electronic System of Payment Information, used to monitor cross-border payment activity for tax compliance purposes.

Article 3 – Applicability
These Terms of Service govern all offers, orders, and agreements made between Dorothy Margaret New York and its customers. These terms are made available electronically prior to the completion of any purchase and are considered accepted upon order confirmation.
Article 4 – Product Offers
All product listings and pricing displayed on our website are subject to change without prior notice. Dorothy Margaret New York reserves the right to modify pricing, descriptions, and availability at its discretion. Listed prices include the product cost and, where applicable, shipping fees. Any customs duties, import taxes, clearance charges, or courier-imposed surcharges are the sole responsibility of the customer unless otherwise specified.
Article 5 – Order Confirmation and Binding Agreement
Once payment has been successfully processed, the order is considered final and binding. Orders may not be cancelled after payment confirmation under any circumstances. Customers wishing to initiate a return must wait until the item has been delivered, in accordance with Articles 6 and 6a.

Article 6 – Right of Withdrawal
Customers are entitled to withdraw from their purchase within 14 calendar days of receiving their order, without needing to provide a reason. Return shipping costs are the responsibility of the customer.
Article 6a – Exceptions to the Right of Withdrawal
Products purchased at a discount of 40% or greater are considered final sale and are not eligible for return, refund, or exchange. Items discounted at less than 40% may be returned in accordance with our standard Return Policy.
Article 7 – Refunds Following Withdrawal
Where a valid withdrawal has been submitted, Dorothy Margaret New York will issue a refund within 30 days of receiving the returned item, provided it is unworn/unused and returned in its original packaging and condition.
A restocking fee of $25.00 per item will be deducted from the refund to cover inspection and processing costs.
Article 8 – Customs Duties and Taxation
Customers are responsible for any customs duties, import taxes, or regulatory compliance obligations applicable in their country of destination. Dorothy Margaret New York does not act as the importer of record for international shipments.
Any additional fees imposed during customs processing, including courier handling charges, are the responsibility of the customer. While we provide the necessary shipping documentation, we cannot guarantee customs clearance. Customers are encouraged to review their country's import regulations prior to placing an order.
Article 9 – CESOP Compliance
In accordance with applicable European Union regulations, payment service providers may be required to report certain cross-border transaction data to the CESOP system. Dorothy Margaret New York complies with all relevant legal obligations where applicable.
Article 10 – Product Compliance and Warranty
All products are represented accurately according to their listed descriptions. Should an item arrive defective, damaged, or materially different from its description, customers must notify us in writing at info@dorothy-margaret.com within 30 days of delivery. Returned items must be provided in their original condition and packaging.
Article 11 – Shipping and Delivery
Orders are typically delivered within 30 days of purchase. In the event of an anticipated delay, customers will be notified within 14 days of placing their order.
Customers are responsible for complying with any customs or import formalities required in their jurisdiction. Dorothy Margaret New York is not liable for delays or additional costs resulting from customs processing, and such delays do not constitute grounds for order cancellation or refund.
Article 12 – Complaints
Complaints must be submitted via email to info@dorothy-margaret.com within 7 days of identifying the issue. We aim to respond within 14 business days. If additional time is required to resolve the matter, the customer will be informed accordingly.
Article 13 – Governing Law and Disputes
These Terms of Service are governed by the laws of the United States. Any disputes arising from these terms will first be addressed through good-faith communication between both parties. If a resolution cannot be reached, the matter will be subject to the jurisdiction of the competent courts of New York, USA.
Nothing in these Terms affects your statutory rights under applicable consumer protection law.
